Vislumbra-se, ent\u00e3o, que o im\u00f3vel rural \u00e9 definido tanto por sua localiza\u00e7\u00e3o quanto por sua destina\u00e7\u00e3o.<\/p>\n<p>Por sua vez, o im\u00f3vel agr\u00e1rio n\u00e3o se define por sua localiza\u00e7\u00e3o, mas sim por sua fun\u00e7\u00e3o socioecon\u00f4mica, cuja destina\u00e7\u00e3o deve consistir na explora\u00e7\u00e3o agr\u00edcola, pecu\u00e1ria, extrativa vegetal ou agroindustrial, respeitando a fun\u00e7\u00e3o social concernente \u00e0 preserva\u00e7\u00e3o do meio ambiente, \u00e0 correta utiliza\u00e7\u00e3o dos recursos naturais e ao aproveitamento racional da terra. Portanto, pode existir im\u00f3vel agr\u00e1rio tanto na zona rural quanto na zona urbana, como, por exemplo, um pomar localizado dentro de uma propriedade privada situada dentro do per\u00edmetro urbano.<\/p>\n<p>Sendo assim, h\u00e1 im\u00f3vel rural que tamb\u00e9m \u00e9 im\u00f3vel agr\u00e1rio (exemplo: uma fazenda situada fora da zona urbana, cuja finalidade \u00e9 a planta\u00e7\u00e3o e a comercializa\u00e7\u00e3o de soja), h\u00e1 im\u00f3vel rural que n\u00e3o \u00e9 im\u00f3vel agr\u00e1rio (exemplo: uma fazenda que serve apenas como resid\u00eancia de lazer ou \u00e1rea de conserva\u00e7\u00e3o ambiental) e h\u00e1 im\u00f3vel agr\u00e1rio que n\u00e3o \u00e9 im\u00f3vel rural (exemplo: cria\u00e7\u00e3o de animais em escala comercial em im\u00f3vel localizada dentro da zona urbana).<\/p>\n<p>A diferen\u00e7a na classifica\u00e7\u00e3o dos im\u00f3veis muitas vezes \u00e9 necess\u00e1ria para fins tribut\u00e1rios, sucess\u00f3rios e registrais, e as implica\u00e7\u00f5es s\u00e3o diversas:<\/p>\n<ul>\n<li>O im\u00f3vel agr\u00e1rio est\u00e1 sujeito ao cumprimento da fun\u00e7\u00e3o social acima mencionada, motivo pelo qual pode ser objeto de desapropria\u00e7\u00e3o para fins de reforma agr\u00e1ria caso n\u00e3o cumpra sua fun\u00e7\u00e3o social. J\u00e1 o im\u00f3vel apenas rural, sem destina\u00e7\u00e3o produtiva, n\u00e3o se submete a ao regime da reforma agr\u00e1ria;<\/li>\n<li>Os contratos agr\u00e1rios, tais como arrendamento e parceria, somente se aplicam aos im\u00f3veis agr\u00e1rios. Caso o im\u00f3vel seja apenas rural (e n\u00e3o tamb\u00e9m agr\u00e1rio), tais contratos n\u00e3o se aplicam;<\/li>\n<li>Em rela\u00e7\u00e3o \u00e0s disputas judiciais envolvendo ocupa\u00e7\u00f5es, o tratamento jur\u00eddico da posse de im\u00f3vel agr\u00e1rio envolve princ\u00edpios e garantias espec\u00edficos do direito agr\u00e1rio, inclusive o direito \u00e0 perman\u00eancia de pequenos produtores em determinadas hip\u00f3teses, o que n\u00e3o se aplica \u00e0 simples posse de im\u00f3vel rural com uso n\u00e3o produtivo;<\/li>\n<li>Acerca das regulariza\u00e7\u00f5es fundi\u00e1rias, licen\u00e7as ambientais e partilhas sucess\u00f3rias, deve-se considerar a natureza e a fun\u00e7\u00e3o do im\u00f3vel, sob pena de nulidade ou inseguran\u00e7a jur\u00eddica.<\/li>\n<\/ul>\n<p>Portanto, compreender essa diferen\u00e7a \u00e9 fundamental para orientar corretamente neg\u00f3cios jur\u00eddicos no campo, garantir seguran\u00e7a nas rela\u00e7\u00f5es contratuais e prevenir lit\u00edgios fundi\u00e1rios.
